Please be aware that colors may vary slightly on different computer monitors and/or browsers. If it is imperative that colors be an exact match, we recommend that you call or email Zamaana before purchase.

All items are original works of art and many have been included in gallery exhibitions. Please be aware that some marks have been incidentally made during their production. These include writing, paint, fingerprints, removed staple marks on edges, folded corners, etc. These marks do not lessen the value of the artwork.

Shipping

All artwork is shipped directly from the artists. Paintings, drawings, lithographs, photographs, prints, and all other works on paper or canvas will be shipped unframed and rolled. In the event of an unavoidable shipping delay, notice will be sent to the email address provided during purchase.

Returns and Refunds

General Refunds: Returns are accepted within 7 days from the date of receiving the artwork. A full refund will be issued to the original credit card used for purchase (less shipping and handling charges). Please contact us at returns@zamaana.com with your order number and reason for return. Items must be received in original condition no later than 7 days of refund request. In order to process a return, the item must have confirmation of delivery to and from the buyer. Zamaana does not pay for return shipping or grant refunds for items that are damaged during return shipping. We strongly recommend buyers purchase insurance for this reason.

Refund due to Damage: Please inspect your items immediately upon receipt. In the event of damage, claims must be reported within 3 days of delivery receipt in order to qualify for a full refund (inclusive of shipping and handling charges) issued to the original credit card used for purchase. Please contact us at returns@zamaana.com with your order number and photos of damage.

Payment

Payments on our secure website will be accepted through most major credit cards (Visa, Mastercard, Discover, American Express).

Microloans

A percentage of the listed price will be contributed to a randomly selected entrepreneur through www.Kiva.org. During checkout, customers will be prompted to confirm notification of the microloan(s) made from their purchase. Please allow 30 days for the notification to be sent to the email address submitted at time of purchase.

Tips for Care of Artwork

Zamaana recommends that all works on canvas be stretched and/or framed soon after delivery. Until then, works should remain protected (in plastic or kept rolled in tube). After the work is stretched and/or framed, care should be taken to place the artwork out of direct sunlight, ultraviolet light, direct heat sources, high humidity, or dusty environments. It is always recommended to place works of canvas in indirect sunlight, recessed lighting, or halogen lights. Do not use feather dusters, dust cloths, or liquid cleaners on paintings. Paintings can be safely dusted using a clean, soft, natural artist's brush in gentle sweeping motions. For any other questions, please write to info@zamaana.com.

Membership

Membership to Zamaana is free. By becoming a member, you certify that all artworks are authentic and you have full legal authorization to sell them. Membership does not imply exclusivity of any kind. In other words, we don’t have exclusive rights over your works or content, and you have the right to sell your works in any other venue.

Current Information - All information submitted to Zamaana must be current and accurate. In the case your email address is incorrect and we are unable to contact you, your profile may be removed without notice. It is very important to keep your inventory current and updated according to availability to avoid buyers wishing to purchase unavailable works. Upon repeated incidents, your account will be reviewed and may be removed from our database.

Profile and Content - After becoming a member, you will be able to upload information for your personal page. You are solely responsible for creating and managing your page. You may change or delete information at any time by editing your profile. All changes are published immediately.

Featured Artists - All artists will be listed in the main directory and rotated into the Featured Artists page.

Termination - You or Zamaana may close your account for any reason at any time. You are not obligated to remain a member once you have created a profile. Please note that backup copies of profiles are not saved. Once deleted, all information is removed from our system. Zamaana employees routinely monitor the site and will remove information deemed offensive or obscene.

Selling

Zamaana's role is to collect and disperse funds received from transactions. We are not otherwise involved with transactions between buyers and artists.

Commission - Zamaana’s commission is 20% of the listed sales price. There are no listing or other fees. You are responsible for setting the prices for your work and shipping. As you set prices, please keep in mind that Zamaana automatically deducts 20% of the sales price. For example, if you list and sell an item for $100, Zamaana will disburse a check to you for $80.

Payment - Zamaana will disburse funds to you approximately 14 days after a completed sale. A sale is “completed” when the buyer receives the artwork. We ask you to wait for the 14-day duration for any refund requests. Funds are sent in US Dollars. For members outside of the US, funds will be sent through wire transfer using the exchange rate current to the day of transfer.

Shipping - You will be responsible for shipping the purchased artwork within 7 days of purchase. Zamaana will send you a copy of the paid receipt with the shipping address to your registered email address. We strongly recommend that you purchase insurance in case of loss or damage. In the event of non-receipt, it is up to the artist to verify the confirmation of delivery. As such, all shipments must be sent with tracking capability.

Taxes - You are responsible for researching your local tax laws to determine if you must collect and report applicable taxes. If so, please factor these taxes into your pricing. Zamaana will not be responsible for any deficient taxes from sales between you and the buyer.

Your use of Zamaana establishes agreement to the following General Terms and Conditions.

1. Zamaana is not responsible for artists' content, images, or communication. As such, Zamaana will not be held responsible for any offensive, harmful, inaccurate, or misleading content.

2. All transactions take place between the buyer and seller. As such, Zamaana will not be held liable for any delay, non-receipt of items, non-payment for items, damage, or loss, financial or otherwise. Zamaana does not transfer legal ownership of artwork from the seller to the buyer.

3. As part of a transaction, both seller and buyer will obtain each other's personal information, such as email address and shipping address. Unless expressed consent is given, a user may not use this information for unsolicited messages or purposes outside of those specified.

4. The website is copyrighted by Zamaana. Content, images, and audio narrations cannot be copied, quoted, recorded, or used for any other purpose, without prior permission from Zamaana.

5. Zamaana maintains the privacy of all visitors who have joined the mailing list. Any information from the website is exclusively used for Zamaana's marketing and promotional activities. You may opt out of these emails at any time. Personal information will never be shared or sold to a third party, unless required to do so by law.

6. Zamaana assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect, your computer equipment or other property on account of your use of the website.

7. Zamaana is not responsible for content, viruses, or privacy practices of external websites linked to and from www.zamaana.com or www.zamaanaarts.com.

Your membership to Zamaana establishes agreement to the following Member Terms and Conditions.

1. You are over the age of 18 and are able to form legally binding contracts.

2. All information submitted to Zamaana is current and accurate. You have the right to use, reproduce, transmit, copy, display, perform, and distribute content made available to Zamaana and its users. You have full, legal authorization to price and sell the items listed with Zamaana.

3. Zamaana does not hold ownership rights to your content. You give Zamaana authority to use, reproduce, transmit, copy, display, perform, and distribute all content, including audio narrations and images, in connection with Zamaana's promotional activities in all forms of media known or later developed, including but not limited to websites, advertisements, direct mail, catalogs, and exhibitions.

4. Zamaana does not hold ownership or exclusive rights to your artwork. You are allowed to sell, give, or otherwise transfer the rights to such artwork to others on a non-exclusive or exclusive basis. In the event that you do sell, give or otherwise transfer ownership of or the exclusive right to the use of your artwork to another party, you will notify Zamaana immediately, and Zamaana will have 90 days from the date it receives the notice to stop, if necessary, Zamaana's future use of the artwork.

5. Zamaana may, with or without notice, remove content, suspend a member's account priveleges, or delete a member's account at its sole discretion.

Zamaana may at any time revise these Terms and Conditions. You are bound by any such revisions and should periodically visit this page to review changes to the Terms and Conditions.
